These Terms of Service ("Terms") govern your use of Mastramind, an AI-powered platform that helps you learn faster and more effectively through interactive lessons, skill trees, and personalized guidance ("Services"). The Services are provided by Mastramind, Inc. ("Mastramind," "we," "us," or "our").
By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use Mastramind.
1. Who Can Use Mastramind
You must be at least 13 years old to use Mastramind. If you're under 18, you must have your parent or guardian's permission. By using the platform, you confirm that you meet these requirements.
2. Your Account
To access certain features, you may need to create an account. You are responsible for maintaining the security of your account and for all activity associated with it. Please notify us immediately if you suspect any unauthorized use.
3. Use of the Services
Mastramind is designed for personal educational use. You agree not to:
- Use Mastramind for any unlawful or harmful purpose.
- Share your login credentials with others.
- Scrape, copy, or reverse engineer any part of the platform.
- Upload or transmit content that is offensive, abusive, or infringes on others' rights.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. User-Generated Content
You may have opportunities to submit, upload, publish, or otherwise share content through Mastramind (e.g., comments, messages, input to AI tools). By doing so:
- You grant Mastramind a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content to operate and improve the Services.
- You represent that you own or have permission to use and share the content.
- You agree not to post anything illegal, obscene, hateful, or infringing.
- We reserve the right to remove user content at our discretion.
5. Intellectual Property
All content on Mastramind — including lessons, exercises, designs, logos, and software — is owned by Mastramind or our licensors. You may not use, copy, or distribute any part of our platform without permission.
6. Digital Millennium Copyright Act (DMCA)
If you believe any content on Mastramind infringes your copyright, you may submit a takedown notice in accordance with the DMCA to:

Please include:
- Your contact information
- Identification of the copyrighted work
- The URL or material you believe is infringing
- A statement that you have a good faith belief the use is unauthorized
- A statement that the information is accurate and you are authorized to act
- Your physical or electronic signature
We may remove the content or disable access while investigating the claim.
7. Data Usage & AI Training
To provide a personalized experience, Mastramind may analyze how you interact with the platform, including your responses, progress, and learning preferences. We may use this data to:
- Improve lesson recommendations and feedback
- Train and fine-tune our AI models
- Enhance your overall learning experience

8. Beta & Experimental Features
From time to time, we may offer features labeled as "Beta," "Experimental," or "Preview." These features are still in development and may not function as expected. By using these features, you understand:
- They may be changed, discontinued, or removed without notice
- We make no warranties regarding their stability or accuracy
- Your feedback may be used to improve these features
- Use them at your own discretion.
9. Subscriptions and Billing
Certain features may require a paid subscription. By signing up for a paid plan, you agree to the pricing and billing terms shown at the time of purchase. All fees are non-refundable unless required by law. We reserve the right to change pricing, but we'll notify you in advance of any increases.
10. Termination
You may stop using Mastramind at any time. We reserve the right to suspend or terminate your access if we believe you've violated these Terms or misused the platform.
11. Disclaimers
Mastramind is provided "as is" and "as available." We make no guarantees that it will meet your learning goals, be error-free, or be available at all times. Your use of the Services is at your own risk.
12. Limitation of Liability
To the fullest extent allowed by law, Mastramind shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including loss of data, opportunity, or reputation.
13. Arbitration and Dispute Resolution
If you have a dispute with us, we encourage you to contact us first. If we cannot resolve it informally, you agree to resolve any claim or dispute with Mastramind through final and binding arbitration, rather than in court, except for certain small claims or equitable relief.
- The arbitration will be conducted by the American Arbitration Association (AAA) under its rules.
- You and Mastramind each waive the right to a jury trial or to participate in a class action.
- You agree to bring claims in your individual capacity only.
- This section is governed by the Federal Arbitration Act.
14. Changes to These Terms
We may revise these Terms from time to time. If we make significant changes, we'll notify you through the platform or by email. Continued use after changes go into effect means you agree to the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
